Deziel v. Sante Quebec
Summary
This class action seeks to obtain damages and punitive damages for violation of the right to privacy provided for in the Charter of Human Rights and Freedoms, in addition to a fault on the part of the Defendant for not having taken all useful and necessary means to ensure the confidentiality of the medical records of users of the health system.
According to Klyden Legal's investigation, several thousand users of the health system in Quebec have had their medical records consulted without consent and without professional justification by a health system stakeholder in recent years, often solely for reasons of personal curiosity, or to transmit medical information to third parties.
We encourage anyone who has received a notification of a breach of confidentiality concerning their medical file to register using the contact form below . We also encourage the public to check directly on the "Carnet Santé Québec" website, in the "Profile" section, to consult the "List of stakeholders who have accessed your health information" to confirm whether any irregularities have been found in their medical file.

Target group
All natural persons and/or their legal representative and/or their guardian/curator/legatee/heir, as well as their agent or any person exercising substitute consent on behalf of that person, as well as their mother and father, who (i) reside or have resided in Quebec and who (ii) have provided personal information to the Defendant which may include, but is not limited to, their name, their health insurance number, information about their private health insurance plan, their date of birth, their address, their telephone number, their government identification numbers, their medical history, including their physical and psychiatric problems and the treatments followed, and who (iii) have presented medical problems to a Defendant establishment for the purpose of obtaining treatment, advice or other services and (iv) whose personal information has been accessed without consent and without valid reason.
Damages (compensation) claimed:
The Plaintiff Geneviève Déziel is claiming, on behalf of the group, $15,000 in damages per person, as well as $5,000 in punitive damages per person for breach of privacy and confidentiality of medical records.
Registration
